Will there any problem if I continue to come to work? How many days should I wait and should apply for premium? Link to comment
Attorney_10 Posted September 17, 2011 Report Share Posted September 17, 2011 Generally, the law permits H1b workers to continue working for a set period of time while the H1B extension petition is pending if the petition was timely filed. In addition, petitions may be upgraded to premium processing at any time while the petition is still pending. gc485process Posted September 18, 2011 Report Share Posted September 18, 2011 If you have timely filed you application then you have 240 days upon expiration of your current h1b that allows to you work on, till you application gets adjudicated. If it takes more than 240 days then you should stop working and await for the decision. If you need it to urgently, then Premium processing can be used. Link to comment
