bvinay2011
My H1B 6th year with all recaptured time is expiring in Nov of 2011. Employer had filed PERM in June 2011, but my PERM went into an Audit due to "Business Necessity..." I think now it takes 6 months for Audit cases to be reviewed. Between June 2011 and Sept 2011, I have one month furlough leaves. Will it help ? What are my options here ? What are my employers option best suited to me ? What is worst case scenario ? (1) Do I need to go out of US when my H1 expires in Nov 2011. (2) My employer shall file the Audit reply next week. Will it be pending and somehow he can apply for my extension. (3) If my PERM is approved, while I am out of Country. Can my extension be filed ? (4) If my PERM is denied, what are the options for me and my employer ? Please advise. Link to comment
prajarajyam
Better consult an experienced lawyer. You can apply for H1B extension and you will get one year extension. Link to comment
