kp9999 Posted September 12, 2011 Report Share Posted September 12, 2011 I have an EAD from 2008 (approved 140-in 2007 oct) from employer A. I joined Emp B for porting from EB3 to EB2. I have some misunderstandings with B as he is not in good terms with me. Presently I have my Labor for EB2(just got approved). If in case My I-140 for EB2 get approved and 485 get ported,.. WHat is the worst this B can do? If 485 after 140 porting can be spoiled by employer?? Worst case what B can do..Removing the I 140(EB2?) In such event will my 485 and 140-EB3 will be still valid with a new EVL from another employer? OR only I140(EB3) will be valid? thanks kp Link to comment
Belle Posted September 12, 2011 Report Share Posted September 12, 2011 Every time you call employer "he", it is not a good situation. The employer may withdraw the I-140. You will be able to keep your case going in EB3 by filing AC21 notification for a different employer. Link to comment
