I-140 Denied.. Confusion over re- apply. Please help me

Hi,

I am M.Sc Computer Science Graduate.. B.sc (3) + M.Sc(2) = 5 years. I have 6 years of Experience. excluding my current company i have 3.5 years of experience.my employer have applied my GC in EB2 category. in I-140 it got RFE for education evaluation. After submitting the education evaluation, it got denied. after that i came to know some issue in the education evaluation.

Now my employer is not interest to re-apply again in EB2. But I want to apply in EB2 only.

Couple of my friends also 3+2 masters degree, their I-40 got approved. So I hope I can also re-apply.

So Please advice can i re-apply in EB2 ?

Also I have another Question, Can i re-use my old labour approval or have to file again ?

You should first figure out the specific problems with your education. For whichever category you qualify (except EB1), you will need an employer to petition for it.
