I filed for H1B thru company B in April 2009 and my petition got approved in Aug 2009. I went to India in sept 2009 for 2 weeks and came back to US, again on L1B with a different I94 and continued working on L1B. For some reason I could not switch over to H1B and went back to India in March 2010, as my L1B got expired. Later, I came back to US again on a fresh L1B in June 2010 and continued working on it. Now, I am planning to switch over to H1B. Is my old H1B petition still valid and can I start directly with a change of status or do I need to file an amended petition for H1B change of status?
