Sreesiri2011 Posted June 23, 2011 Report Share Posted June 23, 2011 It has been nearly 4 months I submitted the documents for the 221g that I received during the H1B stamping visa interview. My wife is in US and wants me to come on H4 visa. My question is a) when my H1B visa is pending at Visa consulate, can I apply for H4 visa stamping? If yes, Do i need to do anything with respect to H1B visa. b) If i get H4 stamped and go to US, Can I use my current H1 petition and do a Change of status (COS). Link to comment

He attended his visa interview where he was give a 221g and its been 8 months now.I have H1b and am working currently. I am planning to get him on H4. We sent an email to his employer to revoke his pending H1B.This we did based on some forums. Once you come to US on H4 you can apply change of status but not for the same petition.There has to be a new petition. Hope this information helps. Link to comment
