Arjunarao Posted September 20, 2011 Report Share Posted September 20, 2011 I changed my visa status from H4 to F1. I applied for OPT and got RFE. If at all my OPT gets denied. Can I immediately apply for change of status to H4 and stay legally in USA as waiting for the change of status Visa.Or I should leave the Country(USA) and attend for H4 visa in India. Link to comment

redgreenbluee Posted September 22, 2011 Report Share Posted September 22, 2011 please consult a lawyer on F1, you are allowed to stay 60 days after completion of study if you didn't apply OPT or your OPT got denied, as long as you are within the 60 day window, you can apply COS to H4.
