Attorney_15 Posted December 9, 2011 Report Share Posted December 9, 2011 USCIS has acknowledged in some meetings that it might be possible to convert a pending I-485 from being a dependent's application and move it to that person's own I-140 becoming a primary applicant. However, this would generally be regarded as that person being ready and able to work for the I-140 petitioner as while it would be a shortcut to filing a new I-485 application, it is the first time that the I-485 applicant is expressing the intent to work in the job offered on becoming a Permanent Resident. Consequently, it would generally be a good idea to speak with an attorney regarding one's particular facts and cirucmstances before deciding on what to do. Link to comment
