coolpal1983 Posted September 22, 2011 Report Share Posted September 22, 2011 Hello folks, I am planning to join a new employer who is about to file H1 transfer for me (they are willing to do only regular processing). However,my current employer wants me to travel back to India next week itself. I have a doubt on whether I can join the new employer 'as soon as they file' the H1 transfer or do I have to wait for the receipt of the transfer application? I heard that the transfer receipt takes up to 2 weeks to arrive and my assignment with my current employer is ending next week. Please advise. Many thanks for your time! Link to comment
Attorney_24 Posted September 24, 2011 Report Share Posted September 24, 2011 Generally a person who is in on H-1B status may be legally allowed to start working for the new employer as soon as the H-1B petition is filed with the USCIS.
