H1B Transfer: Join new employer before receipt?

Hello folks,

I am planning to join a new employer who is about to file H1 transfer for me (they are willing to do only regular processing). However,my current employer wants me to travel back to India next week itself.

I have a doubt on whether I can join the new employer 'as soon as they file' the H1 transfer or do I have to wait for the receipt of the transfer application?

I heard that the transfer receipt takes up to 2 weeks to arrive and my assignment with my current employer is ending next week.

Please advise.

Generally a person who is in on H-1B status may be legally allowed to start working for the new employer as soon as the H-1B petition is filed with the USCIS. Kindly consult with an immigration attorney regarding specific questions on proof of filing and options available to you.
