paapu01 Posted August 28, 2011 Report Share Posted August 28, 2011 Hi All, My employer has less than 50 employees and hence i do not qualify for FMLA pregnancy leave. I am eligible only for California Pregnancy Disability leave which is meant for employers with less than 50 employees. Under this law, employer is not expected to pay. I have a few questions on this. Experts please advice 1.) If I am not paid for 10 to 12 weeks on this leave, will my h1b status be affected ? 2.) Do i as a H1B Employee need to keep some proof that i was on medical leave for a few weeks? It is possible that at sometime, i might have to submit paystubs for the time i wasnt paid? 3.) Is the Employer required to give me a letter that i was not paid because i was on pregnancy leave ? Please suggest Link to comment
