Travelling to India - I797 original is receipt is not received yet...

Hello,

I have transferred my H1B to a new employer (US based E-Commerce IT company with 5000+ employees) and joining this company on 09/19. They have applied in premium processing and it was approved on 09/15. However, I did not receive the I797 yet.

Now, I am travelling to India on 09/23 and planning to attend visa interview on 10/03. My attorney said that they can mail the I797 to my India address (Hyd) if they receive it after 09/22.

If anyone faced this situation could please confirm or share your experience?

1) Can I travel to home country without original I797?

2) Usually, in how many days does USCIS sends the original I797 do attorney? Is same day as on approved date or later?

typically should be the same day.

but, it is ok for you to travel as long as you are sure to receive the 797 at your home address in india.
