PERM DENIED. Appealed. BALCA affirmed denial.

Hello All,

My PERM labor was filed in October 2007. After a long wait it was denied in September 2008. My attorney has appealed the denial. Again after long wait BALCA affirmed the denial last week.

I'm in 8th year of H1 right now. I've got my current H1-B extension till June 2012.

So what are my options ?

My attorney says a new labor should be filed with my current company. I'm fed with my employer. Can I seek a prospective employer who can file a PERM for me ? And do a H1 transfer to the same once the labor is approved ?

I'm also in similar situation. My PERM filed in Oct'2007 is currently with BALCA for more than a year. I'm also on 8th year of H1 valid until Feb'2012.

Do you know for what reasons DOL rejected the case in first place? and reasons BALCA affirmed denial?
