Filing I-824 for Kid while My I-485 pending. Please Help

My EB2 Ind 485 is in pending status. My PD is Jun 2007. I contacted my attorney to initiate I-824 for my Son. But she says that we can file only after my 485 is approved. Few other Sr Attorneys are saying that we can file I-824 while AOS is pending.

If someone filed in these type of circumstances, please advise me on doing it.

What are the documents needed to file I-824 while AOS is pending. USCIS has a list which is applicable for approval 485 cases.

Open form I-824 and you will see that it is a very flexible form. Sometimes it can only be filed after the primary is approved, or an employer may file it to switch the case in CP for the whole family.

Thank you Belle, I spoke to Sr Attorney earlier on a different note and they told me that I could file I-824 while my 485 is in pending. But I couldn't ask him about the process since I heard it for 1st time.
