H1B Transfer being in India

Hi,

I have applied for H1B extension in Aug/2010 and got the approval in Feb/2011 but I have filled my resignation during this period and right now I work with new employer.

I asked during interview with my new employer if they want to get the H1B from previous employer, but they said NO.

Now they are asking me for H1B.

Issue:

My previous employeer did not provide me extension approval reciept to me.

Query:

1- Can H1B transfer happen at this stage of time?

2- If yes, then do I need extension approval reciept from previous employeer?

Technically, there is no such thing as a transfer, anyway.

The new employer just has to file a new H1 application. When approved, you can enter with the old visa and the new approval notice.
