romanb4u
Hello, I am filling DS 160 for H1 B stamping and wondering if any one know what to answer for "Has anyone ever filed an immigrant petition on your...?". My current status is H1B, I 140 approved, haven't applied for I 485. If the answer is YES, what should be the explanation for the same? Either YES or NO - Does it matter for stamping? Please let me know. Link to comment
Joe.F
First, the H1 allows immigration intent. Second, ALWAYS tell the truth. Why is that even a question? Link to comment
tusharvk
yes or no. would not matter for stamping. In my opinion, it should be yes. In the explanation state that your employer has filed I140. Link to comment
gcsgc
U should say 'YES', if anyone has filed an immigrant petition. In 'Explain', u can mention the petitioner who filed it and if I-140 is approved. Link to comment
Philip.Mat07
Is this a renewal stamping after completing 6 years in H1-B and getting an extension for another 3 years based on approved I-140? Link to comment
romanb4u
@Mat07: This is renewal after 5 yrs. I 140 may not come into picture until the completion of 6years I guess. Correct me if I am wrong Link to comment
Khel001
You should say Yes, and put EAC number in details along with petetioner name. This info must have been submitted by your lawyer with 129, see 129 docs for same. Link to comment
