EB2 I-140 porting/interfiling with EB3 I-140 and I-485

Hi,

I have a new EB2 NIW I-140 approved.

I also had an EB3 I-140 approved with PD feb 07 and I have filed I-485 utilizing this.

My new EB2 I-140 does not have the Feb 2007, PD, but has AUG 2007 PD (the date it was applied on).

BUT the EB2 I-140 shows the same A# as my I-485.

I have two issues:

1) capture old priority date to EB2 I-140 and.

2) Interfile new EB2 ti the pending I-485.

any idea how to go about it ?

Pls check with your lawyer. Yes it can be done but as the right way is to have 140 eb2 pd be amended and then interlink to 485 otherwise it takes a while n lawyer intevention is required..
