spgan Posted June 19, 2011 Report Share Posted June 19, 2011 Hi, I have a question regarding transferring my H1B from a Non-Profit to a Profit company. Actually my H1B got approved on Oct 2007 for a Profit Company A and then I transferred my H1B to a Non-Profit company B on May 2009 and working for Company B right now. But now I got an offer from a profit Company C. So, can I transfer my H1B to Profit Company C without any problem? If it is possible to transfer my H1B to profit Company C, can I start immediately or I can start only on Oct 2011? Also, some of my friends told me it is not possible to transfer my H1B to a Profit Company C if you work for a Non-Profit company B. Is that true? Please advise me on this. Regards SP Link to comment
Attorney_6 Posted June 19, 2011 Report Share Posted June 19, 2011 It is possible to get an H1B approved w/o the need to be counted against the cap again in this situation. It is not the same as people who are going from cap exempt to cap subject w/o ever working for a cap subject employer in the past. There can be an immediate start date here. Link to comment
