Can one join the employer after the I-140 is approved, just before filing for AOS? Any experiences? Thanks in Advance. Link to comment

What are the implications of doing such an act? Scenario: Employer A files for PERM & I-140 thinking that employee XYZ will join the company but once PERM and I-140 is approved XYZ will file AOS without notice of the employer A and gets his greencard there by avoiding to join employer A at all. Is this situation possible at all? If yes what will the consequences that employee XYZ would have to face in future. Link to comment
