Is it advisable to resign from my current employer at this stage of the application? Or should I wait till I get the approval notice from USCIS? Thanks! Link to comment
Attorney_20 Posted June 20, 2011 Report Share Posted June 20, 2011 The safest approach would be to wait for the approval (especially since it was filed premium processing anyway). If there were any adverse issues with Company 2's petition and you changed jobs while the case was pending, you could fall out of status if Company 1 withdrew their petition when you resigned. Upon approval, you MUST begin working for the new employer. Link to comment

vohram Posted June 20, 2011 Report Share Posted June 20, 2011 Hi, Further to question posted by visaquery1122, is it true to that chances of any issue spring up (e.g. RFE) while transfering H1 are very rare if you are directly employed by a well known well established firm as opposed to working as a consultant.
