Selvam
The subject line may be confusing. Here is the situation. 1. A H4 person went to India and got her visa stamped at chennai on June, 01, 2011 2. Mean time her husband who is on H1B visa changed his employer and got a new H1B visa on June, 16, 2011. 3. Does his wife need to get another stamping with the new H1B I797 paper? Thanks in advance Link to comment
Attorney_10
Generally, a new H4 visa is not required when the principal H1B holder changes employer. However, it is important to know the expiration dates will likely be different for the H4 holder and the H1B holder. Thus, the H4 holder may be required to extend his/her status prior to the principal H1B holder to avoid falling out of status. Please schedule a consultation with an experienced immigration attorney to discuss the facts relating your case and the options available to you. Link to comment
