My brother and his wife got an approval for GC last week, however, he has shifted to India. I am in USA on H1B visa. i heard of family transfer of Green Card. Attorney_19 Posted September 2, 2011 Report Share Posted September 2, 2011 If the question is whether the brother with the approved GC who has moved back to India can "transfer" his approved GC to his brother who is working in the US on H1B, then the answer is No. No such "transfer of GC" exists under US immigration law. Attorney_19 Posted September 2, 2011 Report Share Posted September 2, 2011 A United States citizen can file an I-130 petition for immigrant relative on behalf of his/her sibling. However, a lawful permanent resident (i.e. green card holder) cannot petition for his/her sibling. Link to comment
