Can the new company continue/take over for filing I140 after PERM approval comes ? OR Does the new company has to start new PERM again ? Assuming all job description and job titles remain same between old company and new company. Link to comment
nycgc Posted June 10, 2011 Report Share Posted June 10, 2011 I went through the same situation as yours. If your PERM gets approved before the acquisition is complete and you get same job title with similar responsibilities in the new company then you might be able to get file I-140 based on your current PERM. Also the acquiring company should be a successor in interest. Link to comment
