krisgolla Posted May 3, 2011 Report Share Posted May 3, 2011 All, My friend is currently on 6th year of his H1, and his company is ready to start filing for his Green Card process. During the market test they found 1 candidate meeting the requirements/criteria and they are saying that job market test is failed and they can't file the labor. My question here is, even with 1 candidate identified as meeting the requirements/criteria is considered as job market test failed? Link to comment

qw.jain8 Posted May 3, 2011 Report Share Posted May 3, 2011 Look ultimately its at the employer's discretion whether or not to hire the employee. 2 persons with same academic background or qualifications in different companies may have completely different skill set. Pittbaby Posted May 10, 2011 Report Share Posted May 10, 2011 all this and only one person answered the friend's question. the answer is yes the market test fails if a person if found to qualify. The question thats should be asked is was that person interviewed . A resume alone does not mean a person qualifies for a job. Link to comment
