gauravs04 Posted May 12, 2011 Report Share Posted May 12, 2011 My current H1B is valid until Jul 2011, and I have 6 more months(taking into account recapture time) left of the total 6years quota. My labor got certified a couple of days back, My question is for how long can I apply the H1B extension now ? Since my labor is certified , can I seek a 12 months + 6 months(from the existing 6 years quote) = 18months extension ? or will I be eligible for only 6 months of extension. Even if I do premium processing, I don;t think I am ample time for getting I140 approval Link to comment
SameerH1Bworker Posted May 12, 2011 Report Share Posted May 12, 2011 I think you should file I-140 ASAP with premium processing. Once you get I-140 approval you can get one/three year of H1b extension. Link to comment
gauravs04 Posted May 13, 2011 Author Report Share Posted May 13, 2011 Thankyou, Sameer, so based on only approved labor certification, we cannot get H1b extension beyond 6 years, For extension of H1 beyond 6 yrs, I140 should be approved. is this understanding correct ? Link to comment
SameerH1Bworker Posted May 13, 2011 Report Share Posted May 13, 2011 If you've filed you PERM(Labor Certification) during 6th year of H1B then for H1B extension requires to have Approved PERM + Approved I-140. Link to comment
