krish99
Please help how to proceed the below my scenario I just completed 6 years on H1B and have I-140 approved with company A. I am switching to another Company B, Company B applied my H1B based on my I-140 which I did in A company. Will use I-140 in the new company B or do I need to start fresh labor, I-140 process? What if the company A cancels my approved I-140? Can they able to withdraw approved I-140? Link to comment
Belle
You cannot use one company's I-140 to get a green card with another company, unless you are eligible for AC21 (I-485 should be pending over 10 days). Approved I-140 may be withdrawn by the sponsor. Link to comment
krish99
Thanks Belle for your feedback. Then this will be re-do over with another company labor, I-140 again... since not filed I-485... Link to comment
Belle
Yes, the employer will have to start a new case. PS Correction to the previous post - 180 days, not 10 days. Link to comment
