a0756944 Posted September 12, 2011 Report Share Posted September 12, 2011 My brother-in-law got laid off on 30Jun2011. Till date he has no job. He in in EB3, AOS was filed in Aug'2007. He has valid EAD and AP. Is there a mandatory requirement (like in H1B), that he has to be in job within 30 days? I was told by one of my collegaue that this requirement is relaxed if you have EAD/AP. EB3 PD is Apr'2004 and is not current yet.. Experts, Belle, Please confirm what is the exact requirement.
