John Su Posted July 19 Report Share Posted July 19 I’m currently on a Green Card (GC) and want to apply for a GC for my wife, who is in India. Initial Plan: My initial plan was to bring my fiancée to the USA on an F1 visa, get married here, and then apply for her Green Card. Unfortunately, her F1 visa application was rejected under section 214(b) in July 2024. Current Plan: Now, I want to marry her in India and apply for her Green Card while she is still in India. Question: Given this situation, will her F1 visa rejection affect the Green Card application process? What`s the current processing time for I130 & I485 ? Quote Link to comment

JoeF Posted July 23 Report Share Posted July 23 An F1 doesn't allow immigration intent, so it is no surprise that it was denied. The PD for spouses of Permanent Residents from India currently is in 2021. That means your spouse would have to wait for 3 years to get an immigrant visa to enter the US with a GC.
