abhishes Posted April 30 Report Share Posted April 30 Hello All, I am on H1-B and my wife is on H4. Last year I spoke to my wife requesting a divorce. She requested me to wait for some time while he will work with her company to move off H4 to her own H1-B. I agreed to her request and decided to wait and 1 year passed. Now my wife suddenly decided to plan a trip to Canada. I fear that she may leave for Canada and not come back (her company may have sponsored a Canadian work permit). My question is that if I have not filed for a divorce and my wife leaves for Canada ... will I still be able to file for divorce in USA? or because she left the country before the papers were filed therefore I cannot file for divorce?
