golden droplets
I am working for a company on H1b with approved I140 (approval from previous company). My spouse is also on H1b.Unfortunately his project got over 1.5 months before and in the current market it is very tough to get a new job. His grace period ends by this month. In this case we decided to get him moved to H4 and apply for H4 EAD based on my previous company's I140 approval. I am also searching for a job as my current company is not doing so well, but nothing is guaranteed as of now. In case I transfer my H1b to a new company with a new job, I am worried what will happen to my husband's H4 and H4 EAD petitions? Will they get rejected or should I file H4 and H4EAD again while doing my H1b transfer? Or should we not initiate the EAD again? I am confused. Anyone faced a situation like this before? How did you handle it? Please advise. Edited April 16 by golden droplets Grammatical mistakes Quote Link to comment
Attorney_20
Your spouse's H4/EAD is still eligible for approval even if you move to a new employer. In fact, you should file an H4/EAD extension with your H1B transfer even if the first H4/EAD applications are still pending. Quote Link to comment
