H1B > B2 > H1B

Got Laid off in October 2023, transferred to B2 after 60 days. My B2 is expiring on 5th May and I have new emplyer who is filing COS to H1 again but starting date is 20th May. I have couple of questions:

1. Will I be considered out of status between 5th May and 20th May?

2. What can I do avoid if #1 is yes? Is B2 extension which will be in pending few days give me window for legal status?

3. Does it have it be COS or Consular Processing?

Appreciate if anyone went through similar process. Very worried about it since after so much hard work, I got job
