compelling circumstance-EAD(H1B)

Hi Team,

Case1:

I have Approved 1-140, Priority date as Feb 2020, My H1B extension was approved after my 6-year completion based on approved I-140, and my H1B was approved until Aug-2026 with Company A.

Company A was asking me to go to India, So I applied for an H1B transfer through Company B and then I resigned from Company A. My 797(Company B applied) is pending with USCIS from Feb 11-2024.

Now I don’t have a Job and searching for it. in this compelling circumstance, shall I apply for EAD(H1B) individually? Is this valid or any complications?

Is this valid case compelling circumstance (no job for 30 days) for applying for EAD(H1B).

 

Case 2: For my spouse, H4 EAD applied on DEC 11th, 2023, with the help of Approved 1-140 from Company A, H4 EAD is still Pending with USCIS.

Now I am not working for Company A, in this case, H4 EAD have any issues?
