ag01 Posted February 9 Report Share Posted February 9 Hi, My Spouse has applied for I539 (change of status from H1b to H4) along with I765 (H4 EAD) in July 2023. He travelled outside of US in Nov 2023 while the applications were pending, got the H4 stamping done and re entered US in Dec 2023. We submitted interfiling to USCIS in Dec 2023 and shared updated H4 i94 and requested to utilize this to process H4 EAD application. So far we still have to both H4 and H4 EAD in "Case was received" status from past 7 months. We submitted inquiry (SR ticket) to check why it is taking so long to process H4 EAD and we received response back that EAD application will be processed only after H4 application is adjudicated. Since my spouse already has H4 stamping, can we ignore current h4 application and submit a new I765 c(26) application to expedited the EAD application. or are there any other ways to expedite current H4 and H4 EAD applications?
