H1B 7th Year extension, PERM pending, PERM not filed within 365 days of H1B max out.

Hi Guys,

Good morning.

My final H1B extension including the outside period approved till : 03/31/2024. (current visa on my passport already expired on 11/30/2023).

My PERM filed Date is : 04/14/2023.

Travelling to India on : 02/19/2024.

 

I'm I eligible to apply 7th year H1B extension (on the 366th day which is 04/15/2024) from India.

 

I humbly request you to please consider this scenario and let me know if any additional information is required from my end.

Provided the time you are requesting on the H1B is after 4/14/2024 and the PERM is still valid, you should be eligible for a 7th year H1B based on the 365day rule.
