reddy99
I hope this message finds you well. Unfortunately, today has been a challenging day for me as I have become a part of the recent layoffs. I'd like to share my current situation for better understanding. 1. Last year, I got a full-time position in Texas with ABC Company and a valid VISA stamped until 2025. Due to the layoff, my last working day with ABC Company is set for Feb 07, 2024. As a consequence, my H1B status will be terminated, and I will no longer be associated with ABC Company after Feb 07, 2024. 2. Prior to my full-time role, I was employed by XYZ Consultant Company. Today, I had a conversation with XYZ Consultant Company's HR, and they indicated that my H1B is still active and valid till Jan 2025 My key question: Can I join XYZ Company without an H1B transfer, considering it has not been revoked? Any legal insights you can provide would be greatly appreciated. Thank you in advance. Quote Link to comment
Attorney_24
Assuming there has been no material change in the terms and conditions of H-1B employment with company XYZ, you may be able to, but it is a grey area. Kindly consult with an immigration attorney to discuss dormant H-1B and the implications. Quote Link to comment
