While the petition with employer A is still pending, can I initiate a transfer to employer B after the 60-day grace period? What happens if the petition with employer A gets rejected after I've initiated the transfer with employer B? Additionally, if I'm on the payroll of employer B and the petition with employer B gets rejected while my petition is still pending with employer A, what are the implications? Quote Link to comment

Attorney_24 Posted January 26 Report Share Posted January 26 Company B can file the H-1B Petition but if company A's petition gets denied, B's Petition could be approved only for Consular Processing. H-1B portability provisions will allow you to start work for a company only when the Petition is filed before the grace period end date.
