Background Check With New Employer (Have recent DUI)

Hello All, 

I am with employer A and secured offer with employer B. 

During holidays I made one bad decision and got in DUI accident.

I am very sorry for what happened and cannot change this. I am working with an experienced attorney to get the court things finalized.

I am supposed to submit for background check and thinking DUI/accident details will show up in background.

What is the best way to inform/communicate/discuss this to new employer?

Please advise or share if anyone of you have the similar experience. Any potential impact on the offer?
