Ikram Huda
Can an employer pay less than the wage indicated in the LCA filing for H1B? Can RSU's and bonuses be counted into the base pay indicated when H1B was filed? If not, what are the steps an employee can take to inform the employer? And if no changes are made, file a complaint with US DOL - Wage and Hour Division? Quote Link to comment
Attorney_24
The employer must pay the offered wages listed in the LCA. As bonuses and RSU are not guaranteed they cannot be used to satisfy the wage requirements. If the H-1B worker is not being paid the required wage they can file a complaint with the DOL.
