Utpal1205
I am currently in India. I had filed my H1B in year 2008 and my petition was approved during that that time. After that I had never been to US or neither got the Visa stamped ( never entered US ). I wanted to file for H1B under cap exempt . Can I still be under cap exempt since my apprval was in 2008 and I never went for stamping and neither I travelled to US till date . Please guide me the process of doing so. Quote Link to comment
Attorney_6
You were never counted against the cap, therefore you are not cap exempt. In order to obtain an H1B approval you will need to go through the lottery first. Quote Link to comment
