I got a new job and applied for my renewal and transfer to new employer within a week - only used 7 days out of the 60 day grace period. I have the receipt (i797c) but have not received the approved h1b yet. If I quit my job when the application is being processed, how long do I have to leave the USA? Attorney_20 Posted November 13, 2023 Report Share Posted November 13, 2023 If you quit the job while the petition is pending, you will be out of status. Once the petition is withdrawn, you will be unlawfully present. If you are unlawfully present for 180 days or more, you then become subject to a three year bar from reentering the U.S. Quote Link to comment
