Amutha Posted November 2, 2023 Report Share Posted November 2, 2023 My MIL came to the US on a visitor visa in January 2020 and could not travel due to the COVID lockdown. We promptly filed for an I-539 extension one month before her I-94 expiration date. However, she had an emergency situation wherein her sister became ill, and she had to leave on one of the first emergency flights while her I-539 petition was still pending. Due to the lockdown and processing delays, we received the biometrics letter one week after she left for India. As per USICS advice, we formally withdrew her I-539 petition, and we received a letter confirming the withdrawal. Question: She is planning to visit us in late November. Will she face any issues at the port of entry? What documents should she carry? She cannot speak English. Should someone accompany her? Quote Link to comment
Attorney_24 Posted November 3, 2023 Report Share Posted November 3, 2023 She should carry her B2 extension receipt notice. If specific questions are asked about her prior visit, she should be able to let them know that she never overstayed and that a B2 extension was timely filed for her back in 2020.
