Ananomys Posted October 26, 2023 Report Share Posted October 26, 2023 I moved out of location B instead of worksite location A before filing the change of address H1B amendment. Since my role was on remote, I only moved because of family. My employer also ran payslips under location B before the amendment. Now, I have an RFE. I am now working on responding to RFE. Will my amendment likely get approved? Will it impact my extension and work visa status? Any advice please. Quote Link to comment
Attorney_24 Posted October 27, 2023 Report Share Posted October 27, 2023 The general rule is that if there is a change in work location outside the metropolitan statistical area or outside commuting distance of the original work location listed in the H-1B petition an H-1B amendment has to be filed first before the move can take place. There are very limited exceptions to the general rule. Failure to comply results in the Beneficiary falling out of status and risk of the H-1B Petition being approved for Consular Processing.
