kelli Anand Posted September 28, 2023 Report Share Posted September 28, 2023 Hi, one Employer/Consultancy processed an H1b Visa for me when I was in India, petition was approved and I have I797 with me, I797 is valid till Dec 2025. stamping was not done, my Spouse got H1b before approved my H1b visa, so I travelled with H4 visa. I am currently in the USA, Recently I found out that my employer is not paying the salary properly. Please let me know, is it possible to transfer the H1b to another employer. Thanks in advance. Attorney_20 Posted September 28, 2023 Report Share Posted September 28, 2023 If your cap subject petition was approved without the I-94 card and you never obtained the visa, it is likely that USCIS would deny an H1B transfer petition. Quote Link to comment
