H1BUser24 Posted September 27, 2023 Report Share Posted September 27, 2023 Hello, My son is sponsoring for me and spouse and filing I-130 online, while filling out the online application for me, it asked him for uploading his birth certificate (for proof of his US citizenship and relationship to me and spouse as parents), then it asked for uploading the marriage certificate of parents, which we did, however, when my spouse's application (a separate I-130) was filled out, it did not ask for uploading our marriage certificate. Does anyone know why it would not ask for marriage certificate for spouse though we are filling two separate I-130? How would it know that husband has already uploaded the marriage certificate? I read the I-130 form instructions to find the list of required evidence for each type of family relationship. For mother: Submit a copy of your birth certificate showing your name and your mother’s name. - This is why the online I-130 for mother did not ask for parents’ marriage certificate. For father: Submit a copy of your birth certificate showing the names of both parents. Also submit a copy of your parents’ marriage certificate establishing that your father was married to your mother. Quote Link to comment
