hlowrld
My wife need to move to Vancouver BC(Canada) due to an opportunity. I live in Bellingham (Washington, USA) which is just a 1.5 hour drive to Vancouver, unless the immigration queue is crazy long on holidays. The company I work for cant help me move my job to Canada for a year or so. So we though of meeting every weekend, I'll drive to Canada on Thursday each week and return on Monday. My concern is if I do this frequent immigration, will USCIS have any concern? Also I heard from an attorney if I stay for more than 180 days in a different country while on H1B USCIS might raise a flag to my employer on why they couldn't hire someone instead of me, which isn't convincing to trust. Did anyone do this before or have any suggestions on how I can better make this happen, it's just for a year. Quote Link to comment
Attorney_20
It is possible to travel back and forth. Every time you reenter, you just need to show that you are returning to the H1B job described in the approved petition. It is only if you lose the job (or the petition expires) that you can no longer use it to travel back and forth between Canada and the US for frequent short trips. Being outside more than 180 days does not automatically raise a red flag as long as the U.S. job offer is available upon your reentry to the U.S. Quote Link to comment
