VihariSai Posted September 7, 2023 Report Share Posted September 7, 2023 I am on a H1b visa with an approved I-140 and my Spouse is working on a H4 EAD. My H1b, Spouse H4 & H4 EAD are set to expire on Feb 2024. I got an offer and My new employer is ready to file h1b, can i file H4 and H4 EAD extension together as well using previously approved I-140 ? Also, My new employer is asking for at-least an year before he initiates the GC process again and port my Priority date. Will this post a challenge for my Spouse H4 EAD or her job ? Attorney_20 Posted September 11, 2023 Report Share Posted September 11, 2023 Yes you can file the H4/EAD extension using your previously approved I-140. If that I-140 has been approved for more than 180 days, your spouse can continue to rely on the old I-140 for EAD renewals even if the company withdraws that I-140. Quote Link to comment
