L1A to H1B Posted September 7, 2023 Report Share Posted September 7, 2023 I am in USA on L1A visa. I had my employer apply for H1B and it got approved effective from Oct 1st, 2023. I have received the softcopy of I-797A and it is written in that as - "The above petition and accompanying request for a change of status have been approved". Does this mean, on Oct 1st, 2023, my visa status will move from L1A to H1B ? I would like to continue with L1A and may think about moving to H1B some time later (say in 2024 or 2025). To do that, what should I do ? Is that I should travel outside USA before Oct 1st and re-enter USA using L1A petition ? Kindly advise asap Quote Link to comment
Attorney_24 Posted September 7, 2023 Report Share Posted September 7, 2023 As your H-1B Petition was approved with the I-94, your status will automatically change to H-1B if you are present in the U.S. on 10/01/2023. If you want to remain in the U.S in L-1 status, leave the US prior to the 10/01 date and enter the US on L-1 anytime after that date. Quote Link to comment

Please help If I wanted to switch back to H1B after couple of years (while I am in US and on L1A), what should I do ? Is it enough to get H1B stamped and re-enter ?
