vin0805
Do I qualify for an extension of my H1-B visa if I return with advance parole to the USA from India? My current H1B valid Until 03-25-2024 Quote Link to comment
Attorney_10
In general, an individual in H1B status who departs the United States and is paroled back into the United States may apply for an extension of H1B status if the individual still has a valid and approved petition. To be clear, this relates to H1B status as reflected on an individual's I-94. A visa is a travel document that must be renewed separately. Quote Link to comment
vin0805
Hi But, My lawyer informed to me that this No but you can file to change his status back to H-1B. If he comes back with AP then the I-94 card will say his status is Parolee AND he can only work if he has a valid EAD. None of the H-1B rules would apply so he can work anywhere and the salary does not matter. Please suggest Quote Link to comment
Attorney_10
Every case is different. Therefore, prior to taking any specific action it is advisable to speak with an experienced U.S. immigration attorney as there are nuances to any situation and approach. Quote Link to comment
