SwatK Posted August 18, 2023 Report Share Posted August 18, 2023 (edited) I'm planning to travel to Mexico for 5 days, and would return to US 1 month before my H1B expires on Sept 30. I'm relocating to India once H1 expires with my current employer(transfer), so we have not filed for extension. Would it be a problem to re-enter without filing for extension? Attorney_15 Posted August 21, 2023 Report Share Posted August 21, 2023 Generally, it is lawful to enter the US with only 1 month remaining on one's H1B status. If CBP questions the person then informing the officer that the individual intends to leave the US at the end of that month should be enough for being admitted back into the US. Quote Link to comment
