Is it fine to file I140 on F1 visa , Next year is my last attempt for H1b lottery , if not selected I would need go to day 1 CPT, Would that case issue to my immigration status to file i140 on F1 ? Attorney_17 Posted August 16, 2023 Report Share Posted August 16, 2023 Because the I-140 is technically an offer for future employment, there is no requirement that you work for the sponsoring employer prior to the green card being approved. This means that, provided you are adhering to the requirements of your F1 status, it should not be an issue to work for the sponsoring employer on OPT as opposed to H1B while waiting for the I-140 approval.
