My wife and kid have their H4 Visa Stamps expired in Jan 2023, but during their last trip to India and when they returned to US in Aug 2022, they got I94 valid till Aug 2025 because of my renewed H1B. I have scheduled for their Visa Stampings in India at the end of this year but doubtful if they will be travelling to India this year. So right now we are planning for a Cruise trip to Mexico/Canada and so have a confusion if they can able to reenter USA based of an expired Visa but with Valid I94. Attorney_24 Posted August 25, 2023 Report Share Posted August 25, 2023 In certain cases a foreign national may be allowed to enter the U.S. with expired visa following a visit to a contiguous territory provided certain conditions are met including being in possession of a valid I-94, trip duration is less than 30 days, has not applied for a visa while abroad etc. For specific questions relating to automatic visa revalidation (AVR) and individual's eligibility please consult with one of our attorneys.
